These Terms of Service govern your use of Cultivate Landscape LLC’s website, communications, estimates, proposals, and services. By requesting an estimate, accepting a proposal, scheduling service, making a payment, or using our website, you agree to these Terms.

2. Services Covered
Cultivate Landscape LLC provides landscape-related services that may include, but are not limited to:

3. Estimates, Proposals, and Acceptance
Estimates and proposals are based on the information available at the time they are prepared. Unless stated otherwise, an estimate is not a binding agreement until accepted by the customer and confirmed by Cultivate Landscape LLC.
A proposal may be accepted by written approval, electronic approval, email confirmation, text confirmation, signed agreement, deposit payment, or another method approved by Cultivate Landscape LLC.
Cultivate Landscape LLC reserves the right to revise an estimate or proposal if site conditions, customer requests, material costs, labor requirements, access limitations, or project scope changes after the original estimate is provided.
4. Scope of Work
The scope of work is limited to the services specifically described in the accepted proposal, estimate, invoice, or written agreement. Any work not expressly included is excluded unless approved in writing.
Additional work may require a change order, revised estimate, or separate invoice.
5. Scheduling and Service Windows
Cultivate Landscape LLC will make reasonable efforts to perform services on the scheduled date or within the scheduled service window. Service dates and times may change due to weather, unsafe conditions, labor availability, equipment issues, material delays, traffic, site access issues, or other circumstances outside our reasonable control.
Recurring maintenance customers may be assigned a regular route or service day, but exact arrival times are not guaranteed unless specifically agreed to in writing.
6. Weather and Site Conditions
Landscape work is affected by weather and ground conditions. Cultivate Landscape LLC may delay, reschedule, modify, or suspend work due to rain, lightning, excessive heat, saturated ground, standing water, unsafe access, storm damage, or any condition that may affect safety, quality, or property protection.
Cultivate Landscape LLC is not responsible for delays caused by weather, acts of God, supply shortages, labor interruptions, government restrictions, utility issues, or other events beyond our reasonable control.
7. Customer Responsibilities
The customer is responsible for providing safe and reasonable access to the property. This includes:
Unlocking gates
Securing pets
Moving vehicles, furniture, toys, hoses, decorations, and personal items when needed
Notifying Cultivate Landscape LLC of access restrictions
Identifying known hazards
Providing access to water or electrical sources when required for the service
Obtaining HOA, landlord, municipal, or property owner approval when required, unless otherwise agreed in writing
If we cannot safely access the property or perform the scheduled work, a trip charge, cancellation fee, or rescheduling fee may apply if disclosed in the estimate, invoice, or service agreement.
8. Pets, Children, and Property Safety
Customers are responsible for keeping pets, children, and others away from active work areas. Cultivate Landscape LLC may stop or reschedule work if people or animals enter a work area in a way that creates a safety concern.
Customers should keep pets off treated lawns, new sod, new plantings, wet mulch, pine straw, fertilized areas, or chemical treatment areas until it is safe to return, based on instructions provided by Cultivate Landscape LLC or the product label.
9. Utilities, Irrigation, Drainage, and Hidden Conditions
The customer is responsible for notifying Cultivate Landscape LLC of all known underground or hidden features, including but not limited to:
Irrigation lines and heads
Drainage pipe
Low-voltage lighting wire
Electrical lines
Internet or cable lines
Gas lines
Septic systems
Invisible dog fencing
Private utilities
Buried objects
Shallow roots
Prior repairs or known problem areas
Cultivate Landscape LLC is not responsible for damage to hidden, buried, improperly installed, shallow, unmarked, or undisclosed items unless caused by our gross negligence or willful misconduct.
If underground utility marking is required, the customer and Cultivate Landscape LLC will determine in writing who is responsible for coordinating it before digging or excavation begins.
10. Existing Property Conditions
Cultivate Landscape LLC is not responsible for pre-existing conditions, including but not limited to:
Diseased turf or plants
Poor soil conditions
Compacted soil
Improper drainage
Irrigation deficiencies
Pest damage
Fungal issues
Prior landscape installation defects
Weak root systems
Shade limitations
Heat stress
Drought stress
Standing water
Grading issues
Damage caused by third parties
We may identify visible concerns as a courtesy, but we are not responsible for inspecting or diagnosing every condition unless inspection or diagnosis is specifically included in the scope of work.
11. Plant Material, Sod, and Living Materials
Plants, sod, turf, and other living materials are affected by weather, watering, sunlight, soil conditions, drainage, pests, disease, customer care, and other factors outside Cultivate Landscape LLC’s control.
Cultivate Landscape LLC does not guarantee the survival, growth rate, bloom timing, color, or long-term performance of plant material, sod, seed, or turf unless a specific written warranty is included in the accepted proposal or service agreement.
Plant sizes, varieties, colors, and material availability may vary based on nursery supply and seasonal conditions. Cultivate Landscape LLC may recommend substitutions of similar quality or appearance when materials are unavailable.
12. Irrigation and Watering
Proper watering is essential for turf, sod, plants, flowers, trees, and shrubs. Unless otherwise agreed in writing, the customer is responsible for watering and maintaining appropriate irrigation after installation.
Cultivate Landscape LLC is not responsible for decline, stress, or failure of plant material caused by overwatering, underwatering, irrigation malfunction, poor drainage, water restrictions, or customer failure to follow watering instructions.
13. Fertilizer, Weed Control, and Treatment Applications
When fertilizer, weed control, pest control, or similar applications are included in the scope of work, they will be performed according to applicable product directions and legal requirements.
Results may vary due to weather, soil conditions, weed pressure, pest pressure, turf health, watering, mowing height, and environmental conditions. Multiple applications or ongoing treatment may be required to achieve desired results.
14. Photos and Marketing Use
Cultivate Landscape LLC may take photos or videos of work areas before, during, and after service for documentation, quality control, training, and marketing.
We will not intentionally publish a customer’s personal identifying information, house number, license plate, or private details without permission. Customers may request that their property photos not be used for marketing by contacting us in writing.
15. Pricing, Deposits, and Payment
Pricing will be stated in the applicable estimate, proposal, invoice, or service agreement. Unless otherwise stated, payment is due upon receipt of invoice.
Cultivate Landscape LLC may require a deposit before scheduling or beginning certain work. Deposits may be applied toward labor, materials, scheduling, equipment, and project preparation. Deposit refundability will be governed by the applicable proposal or written agreement.
The customer agrees to pay all approved charges for services performed, materials purchased, and work completed.
16. Late Payments and Collection Costs
If payment is not received when due, Cultivate Landscape LLC may pause, suspend, or terminate services until the account is brought current.
Where permitted by law and disclosed in the applicable invoice, proposal, or service agreement, late fees, interest, collection costs, attorney’s fees, returned payment fees, or other recovery costs may apply.
17. Cancellations and Rescheduling
Customers should provide reasonable notice for cancellations or rescheduling requests. Cultivate Landscape LLC may charge a cancellation, trip, or restocking fee when materials have been purchased, crews have been dispatched, equipment has been reserved, or work has already begun.
Recurring maintenance cancellations must be submitted in writing. Final billing may include services completed, approved work performed, materials purchased, and any outstanding balance.
18. Change Orders
Any request to change the approved scope of work may result in additional charges and schedule changes. Cultivate Landscape LLC may require written approval before performing additional work.
Verbal requests made on-site may be accepted at Cultivate Landscape LLC’s discretion, but larger changes should be documented in writing.
19. Workmanship
Cultivate Landscape LLC will perform services in a professional manner consistent with reasonable landscape industry practices for the type of service provided.
Any workmanship concern must be reported within a reasonable time after service is completed. Cultivate Landscape LLC must be given an opportunity to inspect and, where appropriate, correct the concern before the customer hires another provider or seeks reimbursement.
This workmanship provision does not cover damage, decline, or failure caused by weather, improper watering, neglect, misuse, pets, pests, disease, third parties, hidden conditions, customer modifications, or conditions outside our reasonable control.
20. No Guarantee of Specific Results
Cultivate Landscape LLC may provide recommendations based on observed property conditions and landscape experience. However, outdoor environments are variable, and we cannot guarantee specific outcomes unless a written guarantee is expressly included in the accepted proposal or service agreement.
21. Website Use
The website is provided for general information, service requests, contact submissions, and customer convenience. Website content is not a guarantee of availability, pricing, timeline, or results.
You agree not to misuse the website, submit false information, interfere with website functionality, attempt unauthorized access, or use the website for unlawful purposes.
22. Online Forms and Service Requests
Submitting an online form, estimate request, text message, email, or voicemail does not create a binding service agreement by itself. A service agreement is created only when Cultivate Landscape LLC accepts the request and confirms the service, proposal, or schedule.
23. Communications
By contacting Cultivate Landscape LLC, you agree that we may respond by phone, email, text message, voicemail, or other reasonable communication method.
Service-related communications may include scheduling, appointment reminders, arrival notices, estimate updates, project updates, invoice reminders, payment reminders, weather delays, and customer support.

26. Payments Through Third-Party Processors
Payments may be processed through secure third-party payment providers. Cultivate Landscape LLC does not control every aspect of third-party payment processing and may receive transaction details, payment status, billing records, or related information needed to manage your account.
Customers are responsible for providing accurate billing information and promptly resolving failed payments, disputed payments, or chargebacks.
27. Intellectual Property
All website content, branding, logos, photos, videos, graphics, text, service descriptions, and other materials created by or for Cultivate Landscape LLC are owned by Cultivate Landscape LLC or used with permission.
You may not copy, reproduce, distribute, modify, or use our content for commercial purposes without written permission.
28. Limitation of Liability
To the fullest extent permitted by law, Cultivate Landscape LLC will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of use, loss of business, loss of property value, or loss of profits.
To the fullest extent permitted by law, Cultivate Landscape LLC’s total liability for any claim related to a service will not exceed the amount paid by the customer for the specific service giving rise to the claim.
Nothing in these Terms limits liability where such limitation is prohibited by law.
29. Customer Indemnification
To the fullest extent permitted by law, the customer agrees to indemnify and hold harmless Cultivate Landscape LLC, its owners, employees, contractors, and representatives from claims, damages, losses, liabilities, costs, and expenses arising from:
Customer-provided information that is inaccurate or incomplete
Unsafe property conditions not disclosed to us
Undisclosed underground or hidden conditions
Customer misuse of completed work
Third-party damage
Customer failure to follow care instructions
Customer violation of these Terms
30. Right to Refuse or Terminate Service
Cultivate Landscape LLC may refuse, pause, or terminate service for reasons including unsafe conditions, nonpayment, abusive conduct, repeated access issues, unreasonable demands, unlawful requests, or conditions that prevent quality work.
The customer remains responsible for payment for approved work already performed and materials already purchased.
31. Privacy
Your use of our website and services is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, protect, and share information.
32. Governing Law
These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles.
Any dispute arising from these Terms, the website, or services provided by Cultivate Landscape LLC will be handled in the courts serving St. Tammany Parish, Louisiana, unless applicable law requires otherwise.
33. Changes to These Terms
Cultivate Landscape LLC may update these Terms from time to time. Updated Terms will be posted with a revised effective date. Continued use of the website or services after updated Terms are posted means you accept the updated Terms.
